The most confusing in a military divorce is the issue of retirement benefits. Many service members do not realize that their spouses may be entitled to share in their military retirement. The inclusion of military benefits as community property is a complex matter involving state and Federal law. Additionally, the Department of Defense provides rules and regulations concerning when and how retirement, disability, and survivor benefits are paid.
Benefits are not the only special issue involved in a military divorce. Also to be considered are child support, custody, and visitation arrangements (especially in the case of deployment or TDY) and the invocation of rights under the Servicemembers Civil Relief Act.
