According to the Social Security Administration (SSA), approximately 63 percent of applicants are denied social security benefits. Within 60 days after receiving the notice of the SSA decision, the applicant has the option to request an appeal. There are four levels of appeal:
- Reconsideration;
- Hearing by an administrative law judge; and
- Review by the Appeals Council
RECONSIDERATION
When deciding on Reconsideration, the Social Security Administration will conduct a complete review of your claim by someone who did not participate in the first determination. Evidence submitted during the initial application and new appeal application will be taken into consideration.

HEARING BY AN ADMINISTRATIVE LAW JUDGE
If the outcome of the Reconsideration is unsuccessful, you may request a hearing by an Administrative Law Judge. The administrative law judge would have had no participation in the initial determination and reconsideration determination. Hearings may be conducted virtually or within 75 miles of the applicant’s residence
REQUEST FOR REVIEW BY THE APPEALS COUNCIL
If, after the three levels of social security disability appeals, you are unsuccessful, you may request a review by Social Security’s Appeal Council. The Appeal Council will take the hearing decision into consideration to ensure it was in accordance with social security law and regulations. Should the Appeal Council decide to review the case, they will either:
- Decide your case outcome; or
- Return it to an Administrative Law Judge.
FEDERAL COURT REVIEW
If after the three levels of social security disability appeals is unsuccessful, the applicant may apply for a Federal Court review. During the Federal Court review, a Federal Judge will review the case in its entirety and determine whether SSA has made an error in denying the claim.
